A surge in cross-border commerce in the past few decades has seen international arbitration as the preferred mode of dispute resolution globally. With the flexibility and autonomy it affords to disputing parties, international arbitration is often seen as a method to resolve disputes efficiently and preserve business relationships. An increase in foreign investment and cross-border transactions in India has led to international arbitration involving Indian parties steadily rising as well.

In that regard, it becomes pertinent to present a comprehensive picture on recent developments that have made India’s arbitration regime consistent with international best practices. With that goal in mind, NDA presents its research paper on the development of Indian arbitration law focusing on various amendments carried out over the past few years, arbitrability of disputes under Indian law, the practice and procedure of international commercial arbitration seated in India as well as seated in a reciprocating country, and various contemporary issues emerging in the Indian arbitration scenario.
