Introduction

With asset classes becoming ever more complex and asset dissipation – in its many forms – a growing threat, it is essential that asset discovery is a central focus in any dispute strategy to ensure the outcome can be monetised.

NDA, in close collaboration with Control Risks, a global risk management consultancy, will discuss best-in-class approaches to asset discovery in the context of global disputes, covering its increasingly important role in settlement negotiations, scoping asset identification and monitoring of known assets, covering both the legal strategy and the investigative approach, as well as discussing enforcement actions.

We will discuss asset discovery and enforcement in both the Indian context and globally, drawing on examples and local context.

Edward Blenk

Principal, Business Intelligence, South East Asia

Control Risks

Edward is a Director in Control Risks’ business intelligence practice for South-East Asia. Based in Singapore, he is a senior investigator who has worked on hundreds of business intelligence, due diligence and problem-solving investigations across South-East Asia, covering dozens of sectors.

Prior to joining Control Risks, Edward worked at Kroll Associates in London, where he managed, wrote, and researched due diligence and business intelligence reports focusing on Indonesia, Malaysia, and Africa. Edward spent 6-and-a-half years in Jakarta, Indonesia, working as an editor and journalist at The Jakarta Post prior to establishing a corporate writing and translation company that served major international companies. Edward also has experience in management consulting, having worked on several product development and strategy consulting projects in London.

 

Siddharth Jain

Senior Consultant, Business Intelligence, South Asia

Siddharth Jain is a Senior Consultant in Control Risks’ business intelligence for South Asia, based in Delhi.

He has more than seven years of experience in conducting due diligence and complex investigations pertaining to fraud, conflict of interest, anti-bribery and corruption, asset-tracing and revenue leakage in South Asia on behalf of domestic and international clients across sectors including oil and gas, automobile, pharmaceuticals, consumer goods, private equity, information technology, media and financial services.

Before Control Risks, Siddharth worked as a risk consultant for a multinational professional services firm in India. Siddharth holds a master’s degree in management from the London School of Economics and Political Science and a bachelor's degree in computer science. He is also a Certified Fraud Examiner (CFE).

Ashish leads the International Dispute Resolution & Investigations practice of Nishith Desai Associates in Singapore. He has super specialism in corporate transactional disputes. He is experienced in handling cross border disputes and has successfully represented clients across various forums including domestic and foreign arbitrations, Supreme Court of India, Company Law Tribunal etc. He is also particularly adept in managing shareholder and construction disputes.

Ashish is a registered foreign lawyer with the Legal Services Regulatory Authority, Singapore, and the Singapore International Commercial Court.

Michael is a Partner and leads Control Risks’ Forensic and Technology practice across Asia Pacific. He is based in Singapore and is a Chartered Professional Accountant (CPA). Michael has over 25 years of experience as a forensic accountant, assisting clients with sensitive situations involving theft, fraud, bribery, money laundering, corruption, and other regulatory or policy breaches. He is recognized as a global leader in the area of dispute resolution involving commercial, investor state (BIT) or state on state, in various forums including arbitration, litigation and mediation.

Michael assists clients in establishing the facts of a situation through meticulous review of the available documentation and the conduct of robust interviews. Michael works closely with corporate clients and their legal advisors when acting as an expert witness in matters involving accounting, damage quantification and regulatory compliance during administrative, civil and criminal proceedings. He sits as an arbitrator and provides expert determinations to facilitate the resolution of disputes by the parties.

Michael has been recognized by his peers for expert witness in Who’s Who Legal since its inception as well as more recently as a Thought Leader.
